Practice Overview

Federal, state, and local governments all have the right to take private property for public projects, such as roads, schools and utilities. This taking of private property is known as eminent domain and is also often referred to as condemnation. While the government has this power, it is not unlimited, and private property owners have a right to participate in the process and to receive fair and just compensation for any property that is taken. If you learn that your property is to be taken through condemnation, you should contact an attorney as soon as possible.

The attorneys at Gess Mattingly & Atchison, P.S.C. represent property owners to ensure that their interests are protected and the compensation received is indeed fair and just. This starts with an evaluation of whether the government actually has the right to take the property. Our attorneys also work with appraisers to determine the proper value of the taking, and negotiate, or sometimes litigate, with the government to ensure that our client’s rights are protected and that our clients receive proper compensation.

If you need the assistance of an experienced eminent domain attorney, please contact Gess Mattingly & Atchison P.S.C.  For over 60 years our attorneys have been providing quality legal services to clients throughout Kentucky … let our tradition of excellence continue with you.
