What is Mail and Wire Fraud?
Mail and wire fraud are usually charged as violations of federal law. A person is guilty of mail fraud if he or she devises or intends to devise a “scheme or artifice to defraud” using the United States Postal Service or any “private or commercial interstate carrier,” such as UPS or FedEx, to further the fraudulent scheme. 18 U.S.C. § 3141. A person is guilty of wire fraud if he or she devises or intends to devise a “scheme or artifice to defraud” and uses a “wire, radio, or television communication” that crosses state or international borders in order to further the fraudulent scheme. 18 U.S.C. §1343.
If you are convicted of either mail or wire fraud in federal court, you could face a sentence of up to twenty years imprisonment, unless the fraudulent scheme related to a “presidentially declared major disaster or emergency”, in which case you could face up to 30 years imprisonment. Generally, however, the actual or intended loss of money involved in the fraudulent scheme, along with your criminal history, will play a role in your sentence.
