Federal, state, and local governments all have the right to take private property for public projects, such as roads, schools and utilities. This taking of private property is known as eminent domain and is also often referred to as condemnation. While the government has this power, it is not unlimited, and private property owners have a right to participate in the process and to receive fair and just compensation for any property that is taken.
